The Learn2Grow "Got Green Hands?" Community Photo Contest Rules

Eligibility: Submit a photo and be chosen as the weekly winner by the Learn2Grow community membership. The Community Photo Contest is open to all legal U.S. residents who are at least eighteen (18) years of age, except employees of Preferred Commerce, Inc. and Learn2Grow® and Gloves Online, and their respective affiliates, partners, subsidiaries, franchises, distributors, advertising and promotion agencies, and the immediate families or household members of each. The Contest is subject to all applicable federal, state and local laws and regulations. Void where prohibited or restricted by law or regulations.

How to enter: The Contest will run for six (6) weeks and include six (6) prizes, one per week. Register on www.learn2grow.com (free). To Enter:

1. You must be a member to post a picture

2. Once you are a member visit the forum page and click on the title: Got Green Hands Contest

3. Once in the Got Green Hands Forum, click on the weekly theme (i.e. Container Garden) post at the top of the thread

4. Finally, click on "post reply" (at the bottom of the page), then "insert photo". 

The Contest is open for submissions Monday September 7th, 2009 at 12:01 am (eastern) through Sunday October 25^th, 2009 at 11:59 pm (eastern)

All entries/registrations become the property of Sponsors and will not be acknowledged or returned. In the event of a dispute over the identity of an online entrant, entry/registration will be deemed submitted by the authorized account holder of the e-mail account. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization(e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

Prizes (6): Six (6) prizewinners will each receive 2 pairs of gardening gloves, ARV (average retail value) of each prize: $9.90 Total ARV of all prizes: $59.40. Winners will be responsible for all other expenses not specifically included herein, and all applicable federal, state and local taxes. Prizes are non-transferable and no substitution by winner or cash equivalent is allowed. Learn2Grow reserves the right to substitute prizes for one of equal or greater value. Each week’s winner will win one (1) prize. Winner’s information (name, email address, mailing address) will be shared with Gloves Online.

Selection of Prize Winners: Voting by the general Learn2grow membership will take place from Monday at 12:01 am to Sunday at 11:59 pm on all eligible entries/registrations received during the Contest period, the week prior. The photo submission that receives the most votes will be declared the winner for that week’s Contest. The winner will be notified by email (add Learn2Grow.com to your sale list) with instructions on how to receive prize. The winner’s name and picture will be featured on the Learn2Grow’s home page for a period of one (1) week. All winners will be required to sign and return an affidavit of eligibility and liability release (and, where permitted, a publicity release) within fourteen (14) days of notification of prize or prize will be forfeited and awarded to an alternate winner. Odds of winning depend on the number of eligible entries/registrations received. In the event of a winning tie, each tying member will receive (2) pairs of Go Green gloves

Release of Liability: By participating, you release Learn2Grow and Gloves Online, and its subsidiaries, affiliates, partners, employees, directors, and agents, including advertising agencies, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Contest and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you release Learn2Grow and Gloves Online, and its affiliates, subsidiaries, directors, employees and agents, and all others associated with the development and execution of this Contest from any such liability and agree that these entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, Contest entrant agrees thatContest (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

Additional Rules: Entry materials/data that have been tampered with or altered, or mass entries/registrations or entries/registrations generated by a script, macro or use of automated devices are void. No mechanically reproduced entries/registrations are eligible. Sponsors are not responsible for: (i) lost, late, misdirected, damaged, garbled, or illegible entries/registrations; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry/registration materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry/registration information by Learn2Grow on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof; or (iii) any injury or damage to entrant's or any other person's computer related to or resulting from participating in the Contest. By participating in the Contest, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of the membership of Learn2Grow, which are final and binding in all matters relating to the Contest. Failure to comply with these official rules may result in disqualification from the Contest. Learn2Grow reserves the right to: (i) permanently disqualify from any contest it sponsors any person it believes has intentionally violated these official rules; and (ii) suspend, modify or terminate the Contest if Learn2Grow believes, in its sole discretion, that malfunction, error, disruption or damage is impairing or will impair the administration, security, fairness, integrity or proper play of the Contest. If Contest is terminated before the end date, Learn2Grow membership will determine the winners from all eligible entries/registrations received as of the termination date. Entry/registration constitutes consent to the use of prizewinner's name, voice, picture and/or likeness without compensation for promotion purposes.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR INTERFERE WITH THE OPERATION OF THE SWEEPSTAKES, IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
